These terms apply to your use of japanmotorsource.com.au (the website), run by Japan Motor Source (ABN 72 687 405 876, “we”, “us”). By using the website you agree to them. If you do not agree, please do not use the website.
1. The website and our import service
The website lets you browse Japanese auction listings, estimate landed costs and contact us. Using the website, creating an account or sending an enquiry does not commit you to buy anything, and does not commit us to provide import services.
Our sourcing and import services are provided under a separate written service agreement, which you sign before we act for you. If anything on the website differs from your service agreement or a written quote from us, the agreement and quote apply. We will never bid on or buy a vehicle for you without your written instruction, including the maximum amount you approve.
2. Auction listings, prices and estimates
Auction listings, photos, auction grades and results come from Japanese auction houses and data providers. We show them as supplied and cannot guarantee they are complete, accurate or current. Lots can be withdrawn, re-listed or sold before the time shown.
Landed-cost figures, price ranges and comparable results on the website are indicative estimates only. They depend on the final auction price, exchange rates, shipping, government charges, compliance work and other factors that change over time. Your written quote is the figure to rely on. Information about import eligibility, compliance and rideshare or platform rules is general guidance, not a confirmation that a particular vehicle can be imported, registered or used for a particular purpose. We confirm eligibility against the specific vehicle before bidding.
3. Your account
If you create an account, please give accurate details and keep your password private. You are responsible for activity on your account. We may suspend or close an account that is used in breach of these terms. You can ask us to close your account at any time.
4. Alerts and emails
Saved-search alerts are a convenience. We aim to send them promptly but cannot guarantee that every matching vehicle will be found or that an alert will reach you before a lot runs. You can pause or delete alerts at any time from your account or from the link in any alert email.
5. Acceptable use
When using the website, you must not:
- copy, scrape, download in bulk or republish listings, auction data, estimates or other content, or access the website with bots or other automated tools;
- interfere with, overload or try to gain unauthorised access to the website;
- submit false, misleading or someone else's details; or
- use the website for any unlawful purpose.
6. Intellectual property
The website's design, text, tools and our own images belong to us or our licensors. Auction photos, auction sheets and listing data belong to the relevant auction houses and data providers. You may view the website for your own personal, non-commercial use of our service, but not otherwise reproduce its content without our written permission.
7. Links to other websites
The website may link to other websites, such as government import resources. We do not control those websites and are not responsible for their content.
8. Australian Consumer Law and liability
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
Subject to that, the website is provided “as is”. To the extent the law allows, we are not liable for any loss arising from your use of, or reliance on, the website or its information, including listing data and estimates, or from the website being unavailable. Our liability for our import services is set out in your service agreement.
9. Privacy
Our Privacy Policy explains how we handle your personal information.
10. Changes
We may update the website and these terms from time to time. The date at the top shows when these terms were last updated. Continuing to use the website after a change means you accept the updated terms.
11. Governing law
These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of its courts.
